Harry Potter And Copyright

Harry Potter & The Sorcerer’s Stone in 5 Minutes | Harry Potter Magical Movie Moments

As we know that copyright subsists in the work of original literary, musical, dramatic, and artistic works. Harry Potter is a character that is used in both literary and cinematograph works. Hence under copyright law, it is protected under the literary as well as cinematography works. But then the question as to who owns the rights of these works? Is it the author of the literary work who owns the rights both in literary as well as cinematograph film or is it the producer Warner Brothers who owns both these rights?

To sell the work to a large audience, authors go to a various publishing house, similar steps were also taken by JK Rowling so now the question of if JK Rowling has given her copyright right to publishers i.e. Bloomsbury Publishing , Scholastic Corporation and Pottermore for publishing the books? And who owns the right to such work? The publishing house has acquired a publishing license agreement from JK Rowling that gives them license to print/produce translation etc. hence JK Rowling still owns harry potter it just she has only licensed her rights to the publishing house for printing and making translations.

It is now established that when it comes to literary works every element attached beginning from publishing to illustrations made, everything is highly protected. In terms of the owner of such rights, it is JK Rowling who owns it and the publishers enjoy such rights by entering into a license agreement.

Why Disney Collected Star Wars And Marvel

Part of the reason why Leia Organa is now technically a Disney Princess and why Disney and Sony are battling it out for the rights to Spiderman actually has to do with Disneys need to compete with the Harry Potter franchise. Because in Disneys eyes, if you cant join them, beat them.

As a result of the theme park snub, Disney has been trying to expand its Disneyland Parks around the world to feature new attractions. Now that Disney has the rights to Star Wars, for example, it opened a new area in 2019 called Star Wars: Galaxys Edge as an attraction to compete with The Wizarding World of Harry Potter. Having learned its lesson from J.K. Rowling and Universal Studios, it opened a themed area dedicated to the one franchise and not just a few Star Wars-themed attractions scattered in Tomorrowland.

And outside of theme parks, the Star Wars and franchises are the only two that can compete with the Wizarding World Franchise. In 2011, Harry Potter and the Deathly Hallows Part 2 topped the list of the highest-grossing films with $1.3 billion. Disney came in 3rd place with Pirates of the Caribbean: On Stranger Tides.

Prior to this, the Harry Potter films were doing so well that Disney bought Star Wars for $4 billion to compete with Harry Potter. Its why the third installment of the Star Wars trilogy features plots similar to the Heros Journey featured in the Harry Potter series.

How Has The Internet Transformed Copyright

There is a very close relationship between copyright and technology. Technologies such as the printing press, fax machine and the photocopying machine have made copying easier. However, none of these technologies has had an impact as significant as the Internet. The Internet has enabled more creation, use and re-use of copyright works. However, the Internet has also enabled mass-scale copying which has challenged copyright law in recent years.

Copyright regulation responded to these developments by extending the scope of copyright protection. The first copyright law only protected printed books and written materials for a period of 14 years. Today, copyright law covers almost every kind of creative work for a much longer period of time .

The Internet and many new online technologies make copying and sharing extremely easy it is quicker, cheaper and more accurate than ever before. These developments are challenging and copyright regulation must continue to adapt.

The concept of authorship still seems to be based on the notion of individual creation, when the reality in the digital context seems to involve collaboration, rather than the individual genius, as a core underpinning of the creative process.

  • Publishing Rights

The publishing rights for any books and novels are stilled owned by JK Rowling, the author of all of the books, including extra books she wrote for charity: Quidditch Through the Ages and Fantastic Beasts and Where To Find Them, among other entries. If the writer decides to write another book in the series, no one can stop her from doing so since the publishing and all creative writing rights are in the writers hands.

The rights for the books have been negotiated with her a lot, but she has been firm on the decision of holding the rights and the creative control to her. Thus, she had decided always to keep the book rights to her if she needs to bring about changes in the source material and because the books were more dear to her than the movies. It is where she gave it her all to publish the characters she had created.

  • Production Rights

The production rights of the franchise have gone from company to company in recent years, Warner Bros owned the production rights for the franchise until 2018, where NBCUniversal bought the rights for themselves, and any future movie or show that will be made about the characters will be according to them and will be overseen by them, so the production rights currently reside with NBCUniversal.

J K Rowling Trademarks

I don

J.K Rowling , born July 31, 1965 in England, is a British screenwriter and author. She is best known for her seven-book Harry Potter series, one of the most popular and best-selling book and film franchises in history. The Harry Potter series has sold more than 500 million copies to date and has evolved into a heavily protected and iconic brand. Despite the widespread success of her books series, Rowling only has six total trademark registrations in the United States.

Rowling adopted her pen name J.K. Rowling when asked by publishers. She has since protected this pen name with trademark registrations. Kathleen was her paternal grandmothers name, and Rowling did not actually have a middle name. Rowlings father was an aircraft engineer in Bristol and her mother used to work as a science technician at Wyedean Comprehensive, where Rowling used to attend school. Rowlings mother was diagnosed with multiple sclerosis and died in 1990, before the Harry Potter books were published.

These years were marked with depression for Rowling, but through her pain, she put her entire focus on writing. In 1995, Rowling completed the manuscript for Harry Potter and the Philosophers Stone and submitted it to twelve publishing houses. Each of them rejected the book that is worth $15 billion today. A year later, the book was accepted and published by Bloomsbury, a publishing house in London.

Harry Potter And The Philosophers Stone

And heres where it all began: now two decades old, the first film in the Harry Potter franchise is a bona fide classic. If its hard to believe this film is now 20, its even hard to see just how little and cute Daniel Radcliffe, Emma Watson, and Rupert Grint just were. In this first instalment, the 11-year-old Harry discovers hes the child of wizarding parents and sets off on his first fateful train trip from Platform Nine and Three Quarters to Hogwarts School of Witchcraft and Wizardry.

Yes, some of the kids acting is a tiny bit wooden, but tell us you dont get the chills when you hear Hagrids iconic line: Youre a wizard, Harry. Were still patiently waiting for our Hogwarts letter in the post.

How A Book Becomes A Bestseller

That is, you cannot sell 10,000 books to a pre-existing list of followers through a personal website or thousands from only one marketplace like Barnes and Noble.

How Does Copyright Regulate Media

HARRY POTTER: RETURN TO HOGWARTS Teaser 2 (2022)

Copyright regulates the use of media in creative productions. We explain this concept in further detail in the Copyright and Creativity section of Copyrightuser.org. For example, if you are producing a video, copyright law says what you can or cannot do with other peoples work in creating the video , and protects the work which you have created. As such, it enables creators to control how other people use their work so that they can be rewarded for their creation.

One of the roles of copyright regulation is to ensure that creators are fairly rewarded for the exploitation of their works and to facilitate the exploitation of such works, in particular through the mechanisms of assignment and licensing.

In general, if you want to re-use the whole or a substantial part of a copyright protected work e.g. you want to create a mash-up of your favourite TV series using your favourite song you need to get permission from all the copyright owners involved. This can be a difficult process, because works like TV programmes have several rights attached to them and each of these rights may have more than one owner. However, many creators are members of collecting societies that license work on their behalf. This often simplifies the process of obtaining a licence.

Once you have created something original, that work is your own and you can license its use in different ways. These include:

1) Signing a private agreement with the person or organisation that wants to use it
